How to instruct me

You may instruct me by contacting me directly, or through your solicitors.

At the start, I shall put my terms in writing and ask you to confirm.

For a rent review, I prefer to be instructed at least 6 months beforehand, so I can monitor the location. In any event, if you are the tenant then please instruct me immediately you receive any communication about the review, such as a request for inspection, a notice or proposal, from the landlord or its advisers. If you are the landlord, then I should prefer to be instructed before notice or proposal is issued.

If you a tenant, then immediacy is important. For your interest to be protected, it may be necessary to serve a counter-notice. Also, if requested, please do not receipt the landlord's notice, just in case it is invalid or served incorrectly.

If you are the landlord then I should prefer to serve notice or issue proposal, so I can ensure the wording meets the requirements of the lease.

For a rent review, I need either the original or a copy of the document(s).
[Originals must be sent by special delivery, or courier, or DX, I shall make copies and return the original to you]

Required documents:
▪ The completed Lease, including any plans
▪ Any Licences to Alter, Assign, Vary the Use, Deed of Variation, etc
▪ Any side-letters.
▪ If you are the tenant, the Notice and/or Proposal from the Landlord, or its advisers
▪ Any other information you feel would be of help, including if available, scale plans.

(If you instruct me direct and do not have the documents, I can obtain them from your Solicitors if easier for you. In which case, please let me have the name and address of your solicitors)

If negotiations have already started but you would prefer to be represented, then I am happy to take over at any stage.

Incidentally, if you are inclined to have a go yourself, then please note that to negotiate a rent review without first reading the lease or checking validity of notices is a recipe for disaster. Notices are an important part of the procedure and must be valid for the review to be implemented. Rent is a product of the lease, not the other way round. I appreciate you are probably more interested in what the rent will be, than bothering with the 'small print' in the lease. However, since every lease is different, to ignore the provisions of your lease and merely focus on the rent could result in agreeing more or less than necessary.
