Schedule of Dilapidations and Repair
During the tenancy, and on expiry and renewal, the premises are to be in a state of repair, condition and decoration as envisaged by the lease.
Repairing and decorating covenants and dilapidation claims can be substantial, so landlords and tenants must understand their obligations.
Tenants should not assume all the items that the landlord requires the tenant to do have to be done.
Landlords must ensure they do not lose out as a result of the tenant hardly doing much repair during the tenancy then trying to defeat a claim for damages.
In association with a long-established firm of chartered building surveyors, I act in a project management capacity providing a comprehensive service for landlords and tenants: inspection and preparation of interim and terminal Schedule of Dilapidations, including costings, service of the schedule and/or notice per 1938 Act, supervision of work, including specifications and obtaining competitive estimates, negotiating claims for damages, dispute resolution acting as expert witness in court; also preparing and agreeing Schedule of Condition on grant of lease, and advice on building construction, maintenance, repair and decoration.
